CLE Seminar: Attorney Ethics: Fee Arrangements, Client Funds, and Privilege

1:00 – 2:00 p.m.          Recent Disciplinary Developments in Attorney Billing Practices

This presentation will survey the history and recent attorney disciplinary developments across the country in the area of fee arrangements and the handling of client funds, with a focus on evolving perspectives about the rules governing flat fees and other alternative fee arrangements.  We will explore (and test!) the stated judicial rationales and justifications for varying disciplinary standards against which different fee arrangements are measured, including different benchmarks applied to the question of how a lawyer “earns” her fee under different billing arrangements and, where material to that question, how to tell that an engagement has ended.

This presentation will provide a refresher on the basics of the attorney-client privilege and explore some of the nuances that attorneys face when representing organizational clients, including a discussion of privilege issues that arise in the context of internal investigations and compliance programs.
