The first panel will discuss the responsibilities of ISPs under copyright law and the DMCA.  It will cover issues including if and when an ISP might become liable for its users’ acts, the nature of the DMCA safe harbor, and related policy concerns.

1:05 – 2:05 p.m.         How to Handle Repeat Infringers
The second panel will go more into depth on what it means for an ISP to terminate “repeat infringers,” both in terms of the legal questions (such as those recently raised by the BMG v. Cox and Sony v. Cox cases, amongst others), best practices, and the implications for users who might find themselves cut off from an essential service.
