The 2005 FCBA Annual Seminar will be held April 29th May 1st, at the Kingsmill Resort in Williamsburg, VA. Annual Seminar Co-Chairs Jim Casserly, Anita Wallgren and Kathy Zachem have worked with their committee to assemble the seminar program around the seminar theme, What's In The Cards? The seminar program will focus on what changes may be coming to the FCC and the telecom industries. Panels will feature FCC Commissioners, NTIA leaders, Bureau Chiefs (invited), and financial analysts looking to the future and how changes in FCC leadership will affect the telecom industry. New FCC Chairman Kevin Martin has been invited to give the keynote speech on Friday afternoon and Eugene J. Huang, Secretary of Technology, Commonwealth of Virginia will give Saturday's keynote speech.
A panel featuring FCC Commissioners Abernathy, Copps and Adelstein, and Mike Gallagher, Assistant Secretary for Communications and Information, U.S. Department of Commerce, is scheduled for 11:00 a.m. on Saturday morning. Other confirmed speakers include Anna-Maria Kovacs, Regulatory Source Associates, LLC and Victor B. Miller IV, Bear, Stearns & Co., Inc. The first seminar panel presentation will begin at 4:00 p.m. on Friday afternoon and will be followed by the seminar keynote speaker. Seminar presentations will resume at 8:45 a.m. Saturday morning and will conclude at 12:00 noon.
Everyone will enjoy the traditional family BBQ dinner and activities on Friday evening, including the always-popular bingo bonanza and the Game Room Challenges coordinated by members of the Young Lawyers Committee. Saturday afternoon will see the golfers take to the course for links for a tournament and the tennis players head to the courts for their tournament. Also planned for Saturday afternoon is an informally organized tour of the National Park Service's Yorktown Battlefield. The resort provides complementary shuttle service to Colonial Williamsburg and Busch Gardens for those who would enjoy the beautiful spring gardens in Colonial Williamsburg or who want to ride the coasters at Busch Gardens. Of course, there is plenty of outlet mall shopping close to the resort. On Saturday evening, the adults will enjoy a special banquet and the younger seminar participants will have a special Kids' Night Out activity. Following the banquet, members will step into the "Casino" for some FCBA-style Texas HoldEm Poker, Blackjack, and other games of chance for young and old, all for the benefit of the FCBA Foundation. The casino will offer instruction to those who need to learn or brush up their card skills as well as tables for the more experienced card sharks at the seminar.

Congressman Joe Barton was first elected to serve the Sixth District of Texas in 1984. In 2004, he was selected by his colleagues to be the Chairman of the House Committee on Energy & Commerce - the oldest standing legislative House committee. Barton follows in the footsteps of former House Speaker Sam Rayburn as only the second Texan elected to this position. The Energy & Commerce Committee has principal House responsibility over matters relating to commerce, public health and marketplace interests.
Joe Barton was born on September 15, 1949 in Waco, Texas. An avid baseball player growing up, he earned a four-year Gifford-Hill Opportunity Award scholarship to Texas A&M University, where he was the outstanding industrial engineering student for the Class of 1972. After earning a Master's of Science degree in Industrial Administration from Purdue University, he joined Ennis Business Forms, where he rose to the position of Assistant to the Vice President. In 1981, he was selected for the prestigious White House Fellows Program, and served as an aide to then-Energy Secretary James B. Edwards. He returned to Texas in 1982 as a natural gas decontrol consultant for Atlantic Richfield Oil and Gas Company before being elected to Congress.
Barton and his wife Terri have homes in Ennis and Arlington, Texas. He has three children, two stepchildren and two grandsons

There are important reasons why FCBA members should attend this year's Annual Seminar, which will be held at the Kingsmill Resort in Williamsburg over the weekend of April 29 to May 1.
We have lined up Commissioners Abernathy, Adelstein and Copps as speakers. Assistant Secretary of Commerce Mike Gallagher, chief of NTIA, will be speaking, too. And we have invited the new FCC chairman, Kevin Martin, to deliver a keynote address. Attendees will have an opportunity to socialize with these government leaders and key staff as well as participate in the seminar sessions where they appear.
The same will be true for the FCC Bureau Chiefs Panel. This panel will afford an unusual opportunity for interaction between our members and the principal staff policy makers at the FCC at a time of leadership transition within the agency. Another session will feature top financial analysts who will identify trends in communications industries and discuss the state of the capital markets. We also will hear from Eugene Huang, Secretary of Technology for the Commonwealth of Virginia concerning the initiatives being taken by Virginia to continue its ascendancy in the high-tech sector.
There is more to the Annual Seminar than business meetings. Members are encouraged to bring their families. There will be a Family Night Dinner on Friday, April 29, followed by bingo and other games. On Saturday there will be a shuttle service available to take members and their families to Colonial Williamsburg and Busch Gardens. Also this year, there will be a guided tour of Yorktown. Kingsmill itself offers a spa, an indoor pool, a fitness center and other facilities geared to family relaxation.
For members, guests and spouses, we will have the traditional Annual Seminar Golf and Tennis Tournaments. On Saturday evening the FCBA's annual cocktail reception and dinner will be followed by a "Casino Night" to benefit the FCBA Foundation. These events are excellent networking opportunities. Members will be able to visit not only with each other and with our special guests, but also with this year's candidates for FCBA elective office, most of whom will be attending.
The Annual Seminar has existed roughly in its current form for more than 20 years. It has grown in size as our association has grown. It appeals to all sectors or our membership and, as noted, has developed into a family-oriented event with strong recreational and social components. We have varied the setting, holding the event at the Homestead, the Hyatt Resort in Cambridge, Maryland (in 2004) and at other locations. While the Annual Seminar draws many of the same members year after year, it also attracts many first-time attendees, particularly members with children. There still is plenty of time to sign up for this year's Annual Seminar and we hope you will do so. More than any other event in the FCBA year, the Annual Seminar embodies our core goals of providing timely, high-quality educational programs plus rare networking opportunities.

The FCBA Cable Practice Committee and Mass Media Practice Committee will co-sponsor a CLE program from 6:00 to 8:15 p.m. on Monday, April 11, 2005 on retransmission consent and must carry issues. The program will be held at the offices of Dow Lohnes & Albertson, 1200 New Hampshire Avenue, NW, Washington, DC. The program is worth 2.0 CLE credits.
This CLE program provides an overview of recent developments and hot issues in the areas of retransmission consent and must carry. The program will open with an overview of the retrans and must carry issues that the FCC has addressed (including the recent order addressing digital television multicasting and dual carriage) and those issues that remain pending. Ben Gaguine, who represented radio and television clients for over forty years, died on March 8. He was 92.
Mr. Gaguine was born in Turkey and lived in South America before his family moved to New York when he was eight. He graduated from Columbia University and its law school. He also received a master's degree in law from George Washington University. He began his career at the FCC, where he became an assistant to the late Commissioner (later Chairman) Rosel Hyde, with whom he maintained a lifelong friendship. He also served as a hearing examiner (now administrative law judge) at the Commission.
In the early 1950's, Mr. Gaguine joined the firm that subsequently became Fly, Shuebruk, Gaguine, Boros & Braun. At that time, the FCC was awarding licenses for new television stations across the country. Comparative hearings involving numerous competing applicants were then a staple of communications law practice. Mr. Gaguine's experience had included serving as a prosecutor at the Nuremburg trials. He quickly developed at the FCC a reputation as a tenacious litigator, particularly adept at cross-examination and oral argument.
In 1969 he was named by Fortune magazine as one of Washington's top communications lawyers. His successes included his representation of the prevailing applicant in the Boston WHDH case, the subject of many articles and a book. The book jacket, alluding to the daunting task of challengers to unseat an existing licensee, said Gaguine's "indefatigable efforts prevented his challenging group from throwing in the towel." That case was the first instance in the post-war era where an incumbent licensee, a newspaper, was displaced by a challenger on the theory that ownership diversity would serve the public interest. Mr. Gaguine continued to represent broadcast clients until he retired in the early 1990's.
Mr. Gaguine is recalled by his former colleagues as a warm-hearted man, who loved his weekly poker game at the University Club, often with prominent members of Congress. He was also a successful investor, who was generous in sharing his considerable expertise with his partners and friends.
His wife, Frances, whom he married in 1944, died in 2000. He is survived by two sons and four grandchildren.

On March 11, 2005, the Florida Chapter kicked off with a bang with its inaugural meeting in Orlando and a lively CLE seminar on the Convergence of Telecommunications and Real Estate. The seminar featured speakers from developer Bonita Bay Group, providers MDU Communications and Knology, the FCC's Media Bureau, optical equipment manufacturer Alloptic, and electronic architecture consultant InfiniSys. The 25 attendees included a number of FCBA members as well as representatives from developers and real estate attorneys.
The Florida Chapter Co-Chairs are presently planning two meetings for the remainder of 2005, with one meeting focused on Florida legislative initiatives and the other focused on a current broadcast media and/or wireless issue. At the University of Texas School of Law 7th Annual Telecommunications Law Conference, the FCBA co-sponsored Jeff Carlisle from the FCC as the keynote luncheon speaker on Friday, March 11.
McKenna's Wagon is a mobile soup and sandwich wagon that goes "on location" to deliver food to the needy. For those who have volunteered, it has been a wonderful experience and a great way to help the needy in the D.C. community.
The Wagon is a white van that is loaded up with sandwiches, snacks and soup. We meet at Martha's Table at 4:45 pm in comfortable clothes and shoes. Martha's Table is located in a yellow building at 2114 Fourteenth Street, NW, in the District, near the intersection of 14th and U Streets. On-street parking is available.
Upon arrival we get assignments (some of us will distribute snacks and sandwiches, others will serve soup), and put on aprons before we depart in the van to 5th and New York Ave., NW (near the new Convention Center). We are driven by one of our experienced volunteers and the trip to distribution location takes about 10-15 minutes.
We serve about 30-75 people per visit including a few mothers who come for food for their families. The area is well patrolled by police. The food distribution is conducted in an efficient, calm and orderly fashion and many of the people we serve are quite appreciative of our efforts. Once we serve all of the food, we do a clean up of the immediate area. Total time for the distribution takes about one hour and we usually return to Martha's Table by or before 6:30 pm.

Many of us are stretched for time these days, but why not consider spending a few hours on a Sunday to help the FCBA Foundation's partner charities? For several years now, the FCBA has been providing volunteers to Martha's Table and McKenna's Wagon. These organizations rely on the good work of our members each month, so grab a friend, colleague or family member and join your fellow FCBA volunteers!
On April 24, members of the FCBA will help prepare meals for the homeless at Martha's Table in the District of Columbia. Martha's Table feeds hundreds of hungry, homeless adults and children on the streets of Washington daily, through its mobile soup kitchen. Children and friends are also welcome. We will begin at 10:00 am and work until 1:00 pm. Martha's Table is located in a yellow building at 2114 Fourteenth Street, NW, in the District, near the intersection of 14th and U Streets. On-street parking is available. Volunteers are asked to bring sandwich fixings (bread and sandwich meat) with them, as the center often runs out of donated food.

Its time to mark your calendars for the 9th Annual FCBA Foundation Honorable Robert E. Lee Memorial Golf Tournament on Monday, June 20, 2005. The group will return to Bull Run Country Club in Haymarket, Virginia. The tournament shotgun start begins at 9:00 a.m., but the driving range opens at 7:00 a.m. and a continental breakfast is served at 7:45 a.m. Golfers will also receive lunch afterwards during the awards ceremony.
The tournament is an enjoyable day for a good cause - raising substantial money for the FCBA Foundation's Scholarship Fund, which provides college funds for deserving District of Columbia high school graduates as well as stipends for unpaid Law School summer interns at government agencies.
The tournament is named in memory of former Federal Communications Commission (FCC) Chairman Robert E. Lee, who passed away in April 1993 after serving on the FCC for almost thirty years. Chairman Lee served as a Commissioner of the FCC for 28 years and was instrumental in the early development of color television, among other contributions to federal communications policy.

Each year the FCBA awards its "Distinguished Service Award" to members of the Association who have demonstrated outstanding service to the Association, the profession, or the national or local community, either this year or in past years. Members of the FCBA are invited to submit nominations for the award, including a description of the nominee's accomplishments. Please send nominations in writing to Stan Zenor no later than Friday, May 6, 2005.

The FCBA organizes volunteers to spend three hours once a quarter helping lower income indviduals through a clinic sponsored by the DC Bar. Our next FCBA volunteer date for the Walk In legal clinic is Saturday May 14th. We have moved to a new location. At the new location, we co-volunteer with the Federal Communications Commission and other members of the private bar. Attorneys receive a half-hour overview/orientation beginning at 9:30 am over bagels and juice. Volunteers are expected to assist clients only during the time they are at the clinic.
The new location is the Max Robinson Clinic, which is located at 2301 Martin Luther King, Jr. Avenue, S.E., Washington, DC 20020. The clinic has the same sponsor and in the same format, but we will be at a different location to help the DC Bar better allocate volunteers.
It is a great opportunity to spend a few hours and get so much more in return. Clients are appreciative and you can actually learn some practical advice and talk to clients who are every day people. As always, encourage your colleagues to help out.
You must either be a member of the DC Bar, have an application pending to the DC bar, or be an employee of the federal government to provide advice. Those who are not DC bar members, paralegals and law students are needed, however, to provide intake and triage. Law students can have the opportunity to sit in on advice sessions. Dress is casual, but respectful. Bring a pen.
