4:05 – 5:15 P.M.        Recent Developments at the FCC and Congress

The first panel will discuss recent FCC and Congressional activities related to robocalls and the TCPA, including an overview of the FCC’s efforts to address TCPA issues in the wake of the D.C. Circuit’s decision in ACA International v. FCC and the 9th Circuit’s decision in Marks v. Crunch San Diego.  In addition, the panelists will discuss the FCC’s proceedings addressing telephone number spoofing, call blocking, and new reassigned number database.  Finally, the panelists will discuss the likelihood of recent legislative efforts to address robocalls.

5:25 – 6:15 p.m.         Recent Developments in the Courts

The second panel will discuss recent court decisions addressing TCPA and robocall issues.  Among other topics, the panelists will review recent opinions that discuss what constitutes an automatic telephone dialing system (“ATDS”) under the TCPA, First Amendment issues raised by the TCPA, the interpretation of “called party,” the regulatory classification of text messages, and the scope of “unsolicited advertisements” under the TCPA.  Additionally, the panelists will provide an overview of recent trends in private class-action TCPA litigation, and how government intervention could potentially affect such trends.
